Parking Information Download the Greenbriar Phase III Vehicle Registration Form (Adobe Acrobat Reader Required) Resolution ADOPTION OF PERMIT PARKING PROCEDURES - Phases I, II and III WHEREAS, Article IV, Part C, Section 13 of the Bylaws of Greenbriar Condominium gives the Board of Directors "...the powers and duties necessary for the administration of the Condominium and may do all such acts and things as are not by the Declaration or these Bylaws specifically directed to be done and excersised exclusively by the members", and WHEREAS, Article IV, Part C, Section 13 (f) of the Bylaws gives the Board the power to make and amend Rules & Regulations respecting the use of the Condominium, and WHEREAS, the Board deems it necessary and desireable to establish certain Procedures for Permit Parking within Greenbriar. NOW THEREFORE BE IT RESOLVED THAT: the attached Permit Parking Procedures are adopted and become effective Feb. 12, 2002 are hereby made part of this resolution Permit Parking Greenbriar Condominium - Phase I, II and III PERMITS 1. The permit is NOT registered to a vehicle, but rather to the UNIT OWNER. It can be used on a rental car, another car in the same unit, a visiting guest, etc. 2. A unit will be issued one numbered parking permit provided the owner of the unit is current in payment of all assessments, charges and fees due to the association. The permit will allow the vehicle in which it is displayed to park in a "Permit Required" space or any other unrestricted parking space. 3. Permits must be displayed hanging from the rear-view mirror with the permit number facing the windshield and be easily visible from the outside of the vehicle. Covered cars using a "Permit Required" space must have a sight window which visibly displays the Greenbriar permit. 4. If a permit is lost, damaged, or stolen, the Homeowner must apply to the Board of Directors for a new permit. The Board will decide on a case-by-case basis whether to issue a new permit. The charge for the first replacement permit will be $75, for the second $100, for the third $150. The Board of Directors shall have the authority to attach additional fines or revoke the permit parking privilege beyond the third replacement. ENFORCEMENT 1. Vehicles parked in the areas marked "Permit Required" without a valid permit are subject to towing at the vehicle owner's expense WITHOUT NOTICE. Towing charges will be set by the towing company in accordance with county laws. 2. Hours of enforcement: seven days a week 5:30 p.m. to 7:00 a.m. MECHANICS OF OPERATION 1. Once this plan is approved, all provisions in th final plan shall be mailed to each homeowner and delivered to each unit with the information that the plan will be put into effect 30 days after CVI has painted "Permit Required" in the approved spaces (see Maps). During these 30 days, permits will be issued and recorded by the on-site office. 2. One reflective, plastic, hanger-type permit showing the tree logo in green and a number below shall be issued to a homeowner, who will sign for it. A renter may obtain the permit on behalf of the owner provided the renter presents a letter of permission from the homeowner and has a current lease on file. The owner may fax a letter giving the tenant his/her right to pick up a permit. This letter must mention the renter by name and address. The owner or renter must also present a picture ID. 3. The permit now becomes part of the unit's "re-sale package;" i.e., the permit is as much a part of the buying/selling of the unit as the By-Laws, etc. Just as the owner charges a damage deposit to the renter, he/she might also charge an additional $75 as a deposit on the parking permit. 4. Each permit will be given a number . All replacement permits will have the same number as the original. If the unit is sold, the new owner will receive--together with the condo documents--the parking permit from the seller. 5. If the towing company finds a car with no parking permit in a "Permit Required" space, they will immediately tow the car, without notice, at the owner's expense. 6. All handicapped spaces will also be designated "Permit Required". Any vehicle parking in such a space must have both a permit and handicapped tags/ permit. If a unit has a handicapped visitor, the permit holder may lend the visitor his/her permit and move his/her car to an open space, reclaiming both permit and space when the visitor leaves. 7. Disputes other than towing, abuses of the system, illegal practices, etc. shall be reported to the Board of Directors in the form of a written complaint for settlement at a hearing to be scheduled as soon as possible. The usual procedure of a 30-day warning shall not apply. 8. Disputes over towing of a vehicle will not be handled by the association. The Prince George's County Vehicle Ausit Unit is the proper venue for people to protest their tow. 9. Owner's whose account is deliquent 30 days or more and in an amount of $50.00 or more will lose their right to park on the common area parking lot, unless a valid and current payment plan is in effect. The parking permit issued to that home will be invalid and any vehicle dispalying that permit number will be subject to immediate towing. Any vehicle belonging to a resident of that home, a visitor or guest of that resident is subject to immediate towing as well. The parking privileges will be revoked until the balance owed to the assocition is paid in full. |
